1. GENERAL TERMS: Welcome to BRASCAR. By requesting, scheduling, or purchasing automotive services from BRASCAR, you agree to the terms and conditions outlined in this agreement. BRASCAR provides automotive maintenance, diagnostics, mechanical repairs, and automotive parts for various vehicle makes and models. These terms apply to customers using our services, whether in person, by phone, through our website, or through other communication channels.
2. ESTIMATES AND DIAGNOSTICS: BRASCAR may provide repair estimates based on the information available at the time of inspection. Estimates are based on the vehicle's reported symptoms and observed conditions. Additional problems may become apparent during inspection or repair. Diagnostic services may involve separate charges, which will be disclosed before work begins. An estimate is not a guarantee that no additional repairs will be necessary. Customers will be notified of additional costs and asked to approve additional work before it is performed. Diagnostic fees and inspection charges will be communicated to the customer before authorization.
3. REPAIR AUTHORIZATION: No repair work beyond the scope of the customer's authorization will be performed without additional approval. By authorizing repairs, the customer agrees to the specific services, parts, labor charges, and other disclosed costs listed on the repair order. Authorization may be documented through a signed work order or another legally valid written method. The customer is responsible for ensuring that they have the legal authority to authorize work on the vehicle. Submitting an appointment request or contacting BRASCAR does not automatically authorize inspections, diagnostics, or repairs.
4. ADDITIONAL REPAIRS: During the repair process, BRASCAR may discover additional mechanical problems, worn components, or safety concerns. If additional work is necessary, BRASCAR will communicate the findings to the customer. Additional costs will be disclosed. Customer approval will be obtained before proceeding. BRASCAR will not intentionally perform unauthorized repairs or charge customers for services that were not approved.
5. PARTS AND MATERIALS: BRASCAR uses both Original Equipment Manufacturer (OEM) and aftermarket automotive parts, depending on vehicle requirements, customer preferences, availability, and repair recommendations. Parts will be identified in the estimate or repair order when applicable. Customers will be informed of the proposed parts before installation. BRASCAR may also offer remanufactured, refurbished, or used parts when appropriate and disclosed to the customer. Customer-supplied parts may be accepted at BRASCAR's discretion. BRASCAR does not assume responsibility for defects, compatibility, quality, or manufacturer warranties associated with customer-supplied parts, except where responsibility is imposed by applicable law. Any applicable labor warranty for work involving customer-supplied parts will be disclosed separately.
6. PRICING AND PAYMENT: All charges will be communicated through an estimate, invoice, or repair order. Full payment of the approved invoice is due before the vehicle is released to the customer, unless another payment arrangement is expressly approved by BRASCAR in writing. Customers are responsible for approved labor, parts, diagnostic fees, applicable taxes, and other disclosed charges. Any applicable deposits or special-order parts payment requirements will be communicated before the order is placed. BRASCAR accepts the payment methods communicated by the business.
7. VEHICLE PICKUP AND STORAGE: Customers are expected to retrieve their vehicles promptly after receiving notification that repairs are complete and the vehicle is ready for pickup. BRASCAR may begin charging a storage fee after three (3) calendar days following notification that the vehicle is ready for pickup, provided the applicable storage fee, conditions, and starting date have been disclosed to the customer in advance. Storage charges will be applied consistently with applicable Texas law. BRASCAR reserves the right to exercise any lawful rights available under Texas law concerning unpaid repair charges and vehicles left at the facility.
8. REPAIR WARRANTY: BRASCAR's labor warranty policy, including its duration, mileage limitations, coverage, and exclusions, will be established separately and communicated to customers in writing through the applicable repair order, invoice, or warranty document. No specific labor warranty duration or mileage coverage is promised by these Terms of Service alone. Any parts warranty will be subject to the applicable manufacturer's or supplier's warranty terms, unless BRASCAR expressly provides additional coverage in writing. Customers must contact BRASCAR to report a potential warranty issue and allow a reasonable opportunity for inspection before authorizing corrective work elsewhere. Nothing in this section limits any consumer rights or warranty obligations that cannot legally be waived under applicable law.
9. TEST DRIVES AND VEHICLE OPERATION: Certain repairs may require operating or test-driving a vehicle to verify its condition and evaluate completed work. Customers must separately authorize reasonable vehicle operation or test drives when required for the requested service. BRASCAR will take reasonable precautions when handling and operating customer vehicles.
10. PRE-EXISTING CONDITIONS AND VEHICLE CONDITION: BRASCAR is not responsible for mechanical failures, defects, damage, or conditions that existed before the vehicle was brought to the facility, except to the extent caused by BRASCAR's negligence or other legally actionable conduct. Customers should disclose known mechanical problems, warning lights, previous repairs, modifications, and other relevant vehicle conditions. Customers are encouraged to remove valuables and personal belongings before leaving their vehicles at the facility.
11. CUSTOMER PROPERTY: BRASCAR is not responsible for personal belongings left inside vehicles, including cash, electronics, tools, documents, or other valuables, except where responsibility is imposed by applicable law. Customers should remove valuable possessions before leaving their vehicles for service.
12. REPAIR COMPLETION TIMES: BRASCAR makes reasonable efforts to complete repairs within the estimated timeframe. However, completion dates are estimates and may change due to Parts availability. Supplier delays. Unexpected mechanical complications. Additional repairs approved by the customer. Circumstances beyond BRASCAR's reasonable control. Customers will be informed of significant delays when reasonably possible.
13. LIMITATION OF LIABILITY: BRASCAR will perform authorized services with reasonable care and in accordance with applicable law. Nothing in these terms excludes or limits liability for negligence, intentional misconduct, or any other liability that cannot legally be excluded or limited. BRASCAR is not responsible for unrelated mechanical failures or pre-existing conditions merely because a vehicle has received service at our facility. Nothing in this agreement is intended to eliminate customer rights that cannot legally be waived.
14. CUSTOMER COMPLAINTS AND DISPUTES: BRASCAR values customer satisfaction and encourages customers to contact us directly if they have concerns about services, charges, or completed repairs. We will make reasonable efforts to review and resolve complaints professionally. Any unresolved dispute will be handled in accordance with applicable Texas and federal law.
15. PRIVACY AND CUSTOMER INFORMATION: BRASCAR may collect customer information necessary to provide estimates, schedule services, process payments, communicate about repairs, and maintain business records. Customer information will be handled in accordance with our Privacy Policy. BRASCAR does not intend to sell customers' personal information.
16. WEBSITE USE: Information provided on the BRASCAR website is intended for general informational purposes. Service descriptions, promotional offers, and advertised prices may be subject to specific conditions and availability. Submitting a website inquiry or appointment request does not automatically authorize vehicle inspections, diagnostics, or repairs. BRASCAR reserves the right to correct inaccurate website information and update service descriptions when necessary.
17. CHANGES TO THESE TERMS: BRASCAR reserves the right to update these Terms of Service when necessary. Updated versions will be published on the BRASCAR website with a revised effective date. The terms applicable to a particular repair transaction will also be subject to the applicable repair order and written agreements.
18. GOVERNING LAW: These Terms of Service shall be governed by the laws of the State of Texas and applicable federal law. Any disputes will be addressed in accordance with applicable legal requirements.
